Software built for healthcare, finance, insurance, and government operates under constraints that most consumer applications never encounter. A bug in a social media feed is an inconvenience. A bug in a claims processing system can violate state insurance regulations. Building for regulated industries does not mean development has to be painfully slow or prohibitively expensive. It means designing compliance into your architecture and processes from the start, rather than retrofitting it later when auditors come knocking. Teams that treat compliance as a first-class design requirement consistently ship faster and cheaper than those who bolt it on after the fact.
Understanding Your Regulatory Landscape
Before writing a single line of code, map the specific regulations that apply to your application. This is not as straightforward as it sounds. A single product can fall under multiple overlapping regulatory frameworks depending on what data it handles, who uses it, and where it operates.
Healthcare: HIPAA (Health Insurance Portability and Accountability Act) governs protected health information (PHI) in the United States. If your application stores, processes, or transmits any data that can identify a patient and relates to their health condition or treatment, HIPAA applies. This includes obvious data like medical records and less obvious data like appointment scheduling information or billing records that reference diagnoses. Beyond HIPAA, you may also face HITECH (Health Information Technology for Economic and Clinical Health Act), state-level health data privacy laws, and FDA regulations if your software qualifies as a medical device under the Software as a Medical Device (SaMD) framework.
Financial services: The regulatory stack includes SOX (Sarbanes-Oxley) for financial reporting controls, PCI DSS for payment card data, SOC 2 for service organization controls, GLBA (Gramm-Leach-Bliley Act) for consumer financial data, BSA/AML (Bank Secrecy Act/Anti-Money Laundering) for transaction monitoring, and state-level money transmitter licenses if you hold or move funds. Fintech companies often underestimate the breadth of financial regulation until they attempt to partner with a bank and receive a 200-item due diligence questionnaire.

Implement field-level encryption in addition to disk-level encryption so that database administrators cannot read sensitive fields without application-level decryption authority. Mask in logs, error messages, and analytics.
Tier 2 (Sensitive): Names, email addresses, dates of birth, addresses when combined with other identifiers. Encrypt at rest with service-managed keys. Restrict access to authorized roles. Redact from non-production environments.
Tier 3 (Internal): Non-identifying operational data, system metrics, configuration settings. Standard encryption at rest, standard access controls.
Implement envelope encryption where possible. The data encryption key (DEK) encrypts the data, and a key encryption key (KEK) managed by a hardware security module (HSM) or cloud KMS encrypts the DEK. This allows key rotation without re-encrypting all data and provides a clean separation between data access and key management.
Data residency requirements may constrain where you host your infrastructure. GDPR requires that EU resident data either stays within the EU/EEA or transfers to countries with adequate data protection. Some healthcare regulations require data to remain within specific geographic boundaries. Multi-region deployments with data routing based on user location are common in regulated applications.
Build data retention and deletion capabilities from day one. HIPAA requires maintaining records for six years. GDPR requires deletion upon user request. These requirements can conflict, and your system must handle both correctly. Implement soft-delete with configurable retention periods, automated purge pipelines, and the ability to produce a complete inventory of where a specific individual’s data exists across your systems.
Building Auditable Access Controls
Regulated industries require knowing exactly who accessed what data, when, and why. This goes beyond basic authentication and authorization into comprehensive access governance.
Implement role-based access control (RBAC) with the principle of least privilege. Each user role should have the minimum permissions necessary for its function. A claims adjuster should access claims in their assigned queue, not all claims in the system. A billing specialist should see financial data relevant to their accounts, not the entire billing database.
Layer attribute-based access control (ABAC) on top of RBAC for fine-grained rules. ABAC policies can enforce contextual constraints: “A physician can view a patient’s records only if that patient is currently in their care panel and the physician is accessing from an approved network location during their credentialed shift hours.”
Every data access must produce an audit log entry. This includes read access, not just writes. HIPAA specifically requires tracking who viewed a patient’s records. Financial regulators expect the ability to reconstruct who had access to material non-public information and when. Log the user identity, timestamp, action performed, resource accessed, fields viewed or modified, and the source IP address.
Implement break-glass procedures for emergency access. There are legitimate scenarios where a user needs access beyond their normal permissions (an emergency department physician treating a patient not in their care panel). Design a mechanism that grants elevated access temporarily, requires a justification, triggers immediate alerts to compliance officers, and creates an enhanced audit trail.

Development Process Controls
Regulators care about your development process, not just the finished product. Your SDLC (Software Development Lifecycle) documentation must demonstrate that you build software with appropriate controls.
Change management: Every code change must be traceable from requirement to deployment. Use pull requests with mandatory code review, link commits to tickets in your project management system, and maintain a change log. Regulators want to see that no single person can make changes to production systems without oversight.
Separation of duties: Developers who write code should not be the same people who deploy it to production. Implement CI/CD pipelines where merging to the main branch triggers automated deployment, removing manual access to production environments. Developers should not have database access in production. Establish a separate operations role or use automated tooling for production support.
Security testing: Integrate static application security testing (SAST) and dynamic application security testing (DAST) into your CI/CD pipeline. Run dependency vulnerability scanning on every build. Environment management: Production data must never exist in development or staging environments. Create synthetic data generators that produce realistic but completely fictional records for testing. If you must use production-like data, implement a de-identification pipeline that strips all sensitive fields and replaces identifiers before data reaches non-production environments.
Preparing for Audits and Assessments
Compliance is not a one-time achievement. It is an ongoing state that you must be prepared to demonstrate at any time. Structure your organization to make audit readiness a continuous process rather than a periodic fire drill.
Documentation: Maintain living documentation of your security policies, data flow diagrams, system architecture, access control matrices, incident response procedures, and business continuity plans. Store these in version control so you can demonstrate their evolution over time. Auditors view static, undated documents with skepticism.
Evidence collection: Automate the collection of compliance evidence wherever possible. Pull access review reports from your identity provider monthly. Export vulnerability scan results from your CI/CD pipeline weekly. Generate encryption status reports from your cloud provider quarterly. When audit season arrives, you should be assembling existing reports, not scrambling to create them.
Incident response: Build and test your incident response plan before you need it. For healthcare applications, you have 60 days to report a breach affecting 500+ individuals to HHS. For financial services, reporting timelines vary by regulator but are typically 36-72 hours. Your plan must include notification procedures, forensic investigation steps, communication templates, and regulatory reporting workflows. Run a tabletop exercise at least annually where your team walks through a simulated breach scenario.
Vendor management: Regulators hold you responsible for your vendors’ compliance. If you use a cloud hosting provider, a payment processor, or a third-party analytics service, you need their compliance certifications (SOC 2 reports, HIPAA BAAs, PCI attestations) on file. Conduct annual vendor reviews and maintain a risk assessment for each critical vendor.
